World Comedy Foundation Fan, Member, Performer & Producer Terms and Agreement of Usage

By submitting your data to the World Comedy Foundation website, you agree to the terms of usage described below. When this Terms and Agreement of Usage to "World Comedy Foundation," “WCF,” "we," "us," or "our," it refers to the World Comedy Foundation and its affiliate brands, including Laugh Social™ ("Laugh Pages", "Laugh Map," and all local Laugh Pages by City name, for example Laugh Brooklyn, Laugh Denver, Laugh Los Angeles, Laugh Austin, Laugh London, and all others represented by the World Comedy Foundation on this website and Facebook Pages) BFF, Rampantly Virtual Comedy Machine™ ("Rampantly," "Rampantly Comedy," and "Rampantly LA"), Cursor Comedy, and comedy.ink. . The World Comedy Foundation is an independent organization that offers web representation, web tools, ticketing and registration services for performers, producers, and hosts of live and live virtual performance entertainment. At this time, free membership (which allows a member to list to perform in shows) is open to the public and talent representation and use of producer tools is by invitation only.

 

The World Comedy Foundation also offers incubation and administrative support to new and emerging comedy brands serving a variety of new media needs, markets and reaches. The World Comedy Foundation is not directly or tacitly affiliated with any individual member(s) or performer(s) representing themselves, offering services, or hosting or producing shows on the World Comedy Foundation or its affiliate brands. World Comedy Foundation solely acts as an intermediary between acts, producers, hosts, venues, and audiences. World Comedy Foundation assumes no liability incidental related to representation, booking, management, production, data storage, indexing and/or expression, publicity, marketing and/or promotion, or the exchange of goods or services offered by individuals, groups or businesses represented here.

 

Fan – For purposes of these Terms, if you provide your email address to the World Comedy Foundation to join the mailing list of a represented performer, if you submit a Contact form to communicate with an performer on the World Comedy Foundation platform, or if you purchase a Fan subscription, you are a “Fan.”
 

Member – For purposes of these Terms, if you provide your email address and password to create a user account on the World Comedy Foundation, publicly identify yourself on the World Comedy Foundation website, upload, store and/or make public photos, video, text, tour dates, and/or other digital media that represents you on the World Comedy Foundation website, or purchase a Member subscription, you are a “Member.”

Performer – For purposes of these Terms, if you use the World Comedy Foundation system to list yourself to perform in live or virtual events via the World Comedy Foundation platform, or if you purchase a Performer subscription, you are a “Performer.” 


Producer – For purposes of these Terms, if you use the World Comedy Foundation system to create and list an event for which Members can publicly register via the World Comedy Foundation website, or if you purchase a Producer subscription, you are an "Producer".
 

Ownership of Intellectual Property
 

Fans, Members, Performers, and Producers agree to only post and/or submit material for which that Fan, Member, Performer and Producer has an ownership right of patent, copyright, and/or other intellectual property right. The World Comedy Foundation reserves the right to remove any content from a World Comedy Foundation Member, or Performer page or website, show listing or event page, or custom Producer or venue page for any reason, including the infringement or contestation of the intellectual property rights of a third party. World Comedy Foundation further reserves the right to share this information internally (for instance, Fan email addresses are shared with Performers whose mailing lists they join; and Performer information is shared with Producers on shows and festivals for which they list to perform) and publicly via the World Comedy Foundation platform (for instance, Performer biographies and media are embedded in their websites, and tour dates are added to the Laugh Social Current feed.)

 

From time to time, the World Comedy Foundation may actively seek to onboard and incubate new or existing live or live virtual open mic comedy shows with member registration through the WCF platform. Members understand that any images, logos, graphics, banners, digital branding and copy (“assets”) designed, curated, and/or otherwise made by the World Comedy Foundation to represent their show(s) on the WCF platform are the property of the World Comedy Foundation. The World Comedy Foundation asserts that the collegial sharing of public domain strengthens and enriches the shared experience of new media entertainment. Thusly, all active, subscription-holding Members in good standing with the World Comedy Foundation platform are given permission to screenshot the World Comedy Foundation website for promotional use on social media. This includes show lists, images generated from the meme machine and virtual background generator, and all public pages of the World Comedy Foundation website. This does not include pages that are password protected or are otherwise considered to be internal to the organization. Members who are in good standing with the World Comedy Foundation platform are given the shared right to reproduce, display, and otherwise use these assets to promote and direct traffic to their comedy shows. Members further understand that any member found using WCF-designed and branded assets to represent their show(s) exclusively on third party websites without prior written agreement, either during or after the show’s tenure on the World Comedy Foundation network, will be found in violation of intellectual property law and may have their membership suspended or revoked.

 

These intellectual property regulations do not apply to paid design work brokered for WCF members, such as the design of tour banners, album art, personal branding and logo kits, business cards and letterheads, and other contracted professional services.

Consent and Release for Use of Likeness
 

  1. Effective on the date of membership, Member, Performer, and Producer grant World Comedy Foundation, its agents, employees, licensees, and successors in interest approval for past use and permission for present and future use of digital media, including but not limited to digital images, photographs, videos, audio recordings, graphics, composite images. This permission and approval is further granted for the recording of live virtual show tapes. This approval of consent and release includes all ownership rights and the absolute and irrevocable right and permission to copyright, use, and publish the photograph likeness of Member, Performer and Producer. The likeness may be used and/or published individually and in conjunction with other photography, video, digital, social and/or interactive media works, in any medium, including without limitation print publications, public broadcast, social media posts, advertising and marketing, and all other forms of electronic publication.
     

  2. The undersigned Member, Performer and/or Producer represents and warrants that (i) no other party has been granted an exclusive license with respect to the Likeness and (ii) no other party’s authorization or consent is required with respect to the permission granted to the World Comedy Foundation under this Consent and Release.
     

  3. The undersigned Member, Performer and/or Producer waives any right that the undersigned may have to inspect or approve of the World Comedy Foundation’s use of the Likeness, or the advertising copy or printed matter that may be used in connection with the use and/or publication of the Likeness. The undersigned Member, Performer and/or Producer releases the World Comedy Foundation and all persons acting under the permission or authority from all claims of libel, slander, invasion of privacy, infringement of copyright or right of publicity, or any other claim related to the likeness (collectively, “Claims”). This release includes without limitation any Claims related to blurring, distortion, alteration, optical illusion, digital alteration, use in composite form whether intentional or otherwise, or use of a fictitious name, that may occur or be produced in the processing or publication of the likeness.

    Additional Live Media Recording Waiver

     

  4. Whether or not a show is recorded on audio and/or video is left to the discretion of the show's Producer. Represented shows wishing to capture recordings of their event on audio and/or video are required to make a note of this in their show description and to allow Member's to access the show's recording upon request. Performers reserve the discretionary right to deny recording of themselves. All recorded shows will contain a note in the page's show description that the show is recorded. At present, tapes recorded of virtual mics for Members and Performers by the World Comedy Foundation are NOT edited in post-production, but are recorded and live mixed during the show only. Due to the nature of live-streamed digital entertainment and the various confounding variables in the delivery of a Performer's audio and video quality that cannot be anticipated, pinpointed or controlled--including but not limited to the Performer's own internet, processor, and/or bandwidth speed, their camera quality, quality and positioning of lighting and/or backdrop, computer or mobile device, operating system and other related issues, the quality of live show recordings offered by the World Comedy Foundation makes no guarantee as to audio/visual quality. The World Comedy Foundation cannot be held responsible for media that is lost or illegible due to errors or glitches in the live-streamed digital recording.
     

  5. BE ADVISED: If your camera is turned on during a virtual mic, your video may appear on the show tape. By keeping your camera and/or microphone turned on at any time during a show recording, you are giving your consent for your image to appear on the show's recording.
     

  6. If the show in question is being live-streamed to a third party platform such as Facebook, Instagram or Youtube, The World Comedy Foundation reserves the right to maintain public access to the show tape on the internet in perpetuity.


Authorized Seller - Performers agree that they are Producers agrees they are authorized to utilize the World Comedy Foundation platform to represent, promote, and sell tickets to their event(s) to performers, audience and the general public. Fraudulent representation by a Producer of event(s), is a criminal offense, which renders this agreement void and allows World Comedy Foundation to provide full refunds to event attendees. World Comedy Foundation will assist law enforcement in prosecuting any fraudulent use of World Comedy Foundation services, and will legally seek any and all compensation for damages due to fraudulent representation.
 

  1. Data Security – Due to the nature of the World Comedy Foundation’s web interface and public and private web tools for representation, management and communication with Members, Performers, and Producers, Producer will have access to performer personal information. Producer agrees to protect performer personal information, and further agree not to use the data in any way inconsistent with any local, state, federal, United Kingdom, European Union, or other data privacy laws or statutes with jurisdiction. Should Producer sell tickets or registration to citizens protected by the General Data Protection Regulation (GDPR), Producer agrees to respect and abide by the GDPR transparency, consent, accuracy, data deletion, and other requirements.
     

  2. Amendments – The World Comedy Foundation reserves the right to make amendments to these terms at any time. If and when these Terms are modified in any way, members will be prompted to review the new Terms before opting in to further representation by World Comedy Foundation.
     

  3. Event Promotion and Advertising - This Agreement does not obligate World Comedy Foundation to promote or advertise any event listed with World Comedy Foundation. Producer acknowledges and understands it is Producer’s sole responsibility to promote and/or advertise their event.
     

  4. Ticket and Registration Pricing - On a case-by-case basis, The World Comedy Foundation may provide Producer with ticket sales services with no initial fees or start-up charges, unless specifically agreed upon. All external ticket and registration pricing, either in person or via third party platforms, is solely determined by Producer. Producer is exclusively responsible for all city, municipal, county, district, state and federal taxes. 
     

  5. Ticket Commission

    1. On a case-by-case basis, The World Comedy Foundation offers the option for World Comedy Foundation members to claim direct-to-member ticket commission for tickets they sell. Ticket commission and show eligibility is variable. All shows offering ticket commission are clearly marked on the show page.
       

    2. Ticket Commission is a service only offered to World Comedy Foundation members holding annual paid Member accounts. Members with unpaid and monthly accounts are not eligible to receive ticket commission.
       

    3. All annual members can receive ticket commission on eligible tickets they sell. A World Comedy Foundation member does not need to perform in, host, or produce a show to receive ticket commission.
       

    4. For an annual member to receive ticket commission, a ticket purchaser must list that member’s full first and last name in the commission input field at checkout. This is the only way that the World Comedy Foundation will verify that a member has earned ticket commission. The World Comedy Foundation is not liable to assign or disburse for ticket purchases for which the commission field is illegible or left blank. A blank or illegible commission field will render that ticket’s commission void, and the full cost of the ticket will go to the World Comedy Foundation.
       

    5. The World Comedy Foundation uses the 1099-NEC form to report non-employment income to the Internal Revenue Service (IRS.) The World Comedy Foundation is required to issue a 1099 form to individual taxpayer who has received at least $600 or more in non-employment income during the tax year. Although members who earn less than $600 may not receive a 1099-NEC, they still must report all income when filing their taxes. A copy of the 1099-NEC form and the instructions are located on the IRS website. 
       

  6. Change of Event - Should the listed show, mic or event change for any reason, Producer agrees that refunds will be given to ticket and registration purchasers at the purchaser's request. The World Comedy Foundation makes no guarantee for the availability of any show theme, type, location, or price point.
     

  7. Indemnification and Hold Harmless

    1. At its own expense, Member, Performer and Producer agrees, acknowledges, and understands it will indemnify and hold harmless World Comedy Foundation, its officers, agents, employees and assigns, from and against all claims, demands, losses, costs, penalties, damages, judgments and suits at law or in equity, of whatsoever nature (hereafter "actions"), brought against World Comedy Foundation arising from, in connection with, or incident to the performance of, or failure to perform the provisions of this Agreement by Producer, Performer, Member, its officers, agents, employees or assigns. Producer, Performer, and Member further agrees to defend World Comedy Foundation in any litigation, including payment of any costs or attorney's fees, for any claims or action commenced thereon arising out of or in connection with such acts or activities authorized by this Agreement.
       

    2. The above indemnity obligation shall not include such claims, costs damages or expenses that may be caused by the sole responsibility of the World Comedy Foundation. Additionally, if the claims or damages are caused by or the result from the concurrent negligence of (a) Producer, its officers, agents, employees or assigns and (b) World Comedy Foundation, its officers, agents, employees or assigns, this indemnity provision shall be valid and enforceable only to the extent of the negligence of Producer, Performer and Member and that of its officers, agents, employees or assigns.
       

  8. Severability - If any term or provision of this Agreement or the application thereof to any person or circumstances shall, to any extent, be invalid or unenforceable, the remainder of this Agreement, or the application of such term or provision to persons or circumstances other than those as to which it is held invalid or unenforceable, shall not be affected thereby and shall continue in full force and effect.
     

  9. Limitation of Liability - Member, Performer and/or Producer understands and agrees that The World Comedy Foundation shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data or other intangible losses (even if the Worldl Comedy Foundation has been advised of the possibility of such damages). Some jurisdictions do not allow the exclusion of the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you. In no event will The World Comedy Foundation’s total cumulative damages exceed US$100.00.
     

  10. Disclaimer of Warranties - Member, Performer and/or Producer understands and agrees that the World Comedy Foundation’s website, web tools, production, promotion and ticketing services are provided on an "as is" and "as available" basis, and that the World Comedy Foundation assumes no responsibility for the timeliness, deletion, failure to store, or retention of any user communications or personalization settings. The World Comedy Foundation will not be liable for failure to perform any obligation under this Agreement if such failure is caused by Internet outages or delays, unauthorized access (hacking), earthquakes, communications outages, fire, flood, war, an act of God, or the occurrence of any other unforeseen contingency beyond the reasonable control of the World Comedy Foundation.
     

  11. Disputes

    1. If a dispute relates to or arises out of this contract, or the breach thereof, and if said dispute or breach cannot be settled through negotiation, the parties agree first to try in good faith to settle the dispute by mediation under the Commercial Mediation Rules of the American Arbitration Association, before resorting to arbitration.
       

    2. Any dispute arising out of or relating to these terms and conditions, or the breach thereof, that cannot be resolved by mediation within 30 days shall be finally resolved by arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, and judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction. The arbitration will be conducted in the English language in the City of Cleveland, Ohio, United States, in accordance with the United States Arbitration Act. There will be one independent arbitrator, named in accordance with such rules. The award of the arbitrator shall be accompanied by a statement of the reasons upon which the award is based. The arbitrator shall decide the dispute in accordance with the substantive law of the State of Ohio in the United States. In the case of international disputes, the International Bar Association Rules on the Taking of Evidence in International Commercial Arbitration will provide discovery rules.  The arbitrator will be given the authority to award reasonable attorney and collections fees in addition to any other award.
       

    3. Governing Law and Venue - The parties agree that any dispute will be governed by the laws and codes of the State of Ohio, United States. The parties further agree that in the event any legal action is instituted, mediation, arbitration, or any other legal action, by either party, jurisdiction and venue will be in the City of Cleveland, State of Ohio, United States.
       

  12. Entire Agreement - This Agreement, together with all attachments hereto, constitutes the entire agreement between the parties. There are no terms, obligations, covenants or conditions other than those contained herein. No modification or amendment of this Agreement shall be valid and effective unless evidenced by an agreement in writing.
     

 

Privacy Notice for California Residents

Effective date: June 1, 2022

This Privacy Notice for California Residents supplements the information contained in the World Comedy Foundation Privacy Policy and applies to all users and others who reside in the State of California ('Users' or 'you').

 

Information We Collect

The World Comedy Foundation collects information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device ('Personal Information'). In particular, the World Comey Foundation has collected the following categories of Personal Information from its Users within the last twelve (12) months:

  1. Identifiers - A real name, alias, unique personal identifier, online identifier, Internet Protocol address, email address, account name, billing and/or mailing address, telephone number or other similar identifiers.

  2. Commercial information - Records of products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.

  3. Internet or other similar network activity - Browsing history, search history, information on a user's interaction with the World Comedy Foundation website, applications, or products.

  4. Geolocation data – Internet Protocol address

 

How Information is Collected
The World Comedy Foundation collects information in two ways:

 

  1. Directly from users. For example, when a member creates their own public website on the World Comedy Foundation, they provide personal information about themselves including their biography (“Bio”), their past and future whereabouts (“Tour Dates”) and photos and graphics of themselves, their art and their events. Additionally, when purchasing an event ticket, a user must enter their credit card number, name, billing address, mailing address, email address, etc.
     

  2. Indirectly from users. For example, tracking a user's actions while using the World Comedy Foundation website or other applications.

 

Use of Personal Information
 

The World Comedy Foundation may use or disclose the personal information we collect for one or more of the following business purposes:

  1. To fulfill or meet the reason you provided the information. For example, if you provide personal information to your WCF website that can be used by public with interest in connecting directly with you to book you or collaborate with you; if you registered to perform on a show for which a Producer is using the WCF Hosting App to access performer information so that they can mange the show’s list and introduce you to the public audience with details about you; or if you purchased an event ticket and your name needs to be on the will-call list to gain entry into the venue. If you provide your personal information to purchase a product or service, we will use that information to process your payment and facilitate delivery. We may also save your information to facilitate new product orders or process refunds.
     

  2. To process your requests, purchases, transactions, and payments and prevent transactional fraud.
     

  3. To provide you with support and to respond to your inquiries, including to investigate and address your concerns and monitor and improve our responses.
     

  4. To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.
     

  5. As described to you when collecting your personal information or as otherwise set forth in the California Consumer Privacy Act (CCPA).

 

Sharing Personal Information
The World Comedy Foundation shares personal information with third parties for business purposes. When personal information is disclosed for a business purpose, the World Comedy Foundation enters into a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract. Examples of third parties that the World Comedy Foundation shares personal information with for business purposes are:

 

  1. Producers who put on an event that a Performer may have listed themselves for, or an audience may have purchased tickets to.
     

  2. Other Members who use the WCF system to identify and locate Performers for their own events.
     

  3. Credit card processors or other payment processors.
     

  4. Other service providers that may have access to portions of the World Comedy Foundation databases.

 

Sale of Personal Information

The World Comedy Foundation does not sell user information.

 

Access to Specific Information and Data Portability Rights

You have the right to request that the World Comedy Foundation disclose information to you about the collection and use of user Personal Information over the past 12 months. Once we receive and confirm your verifiable consumer request (see Exercising Your Portability, Access, and Data Deletion Rights below), we will disclose to you:
 

  1. The personal information we collected about you.
     

  2. The sources for the personal information we collected about you.
     

  3. Our commercial purpose for collecting your personal information.
     

  4. The categories of third parties with whom we share that personal information for business purposes.
     

  5. If we disclosed your personal information for a business purpose, the World Comedy Foundation will disclose to you a list identifying the Personal Information categories that each category of recipient obtained.

 

Deletion Request Rights

You have the right to request that the World Comedy Foundation delete any of your personal information collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, and Deletion Rights below), we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.
 

The World Comedy Foundation may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  1. Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
     

  2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
     

  3. Debug products to identify and repair errors that impair existing intended functionality.
     

  4. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.).
     

  5. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
     

  6. Comply with a legal obligation.
     

  7. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

 

Exercising Access, Data Portability, and Deletion Rights

To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us using one of the following methods:

Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:
 

  1. Provide sufficient information that allows us to reasonably verify you are the person about whom we’ve collected personal information or an authorized representative.
     

  2. Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
     

The World Comedy Foundation cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us.
 

The World Comedy Foundation will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

 

Response, Timing, and Information Format

The World Comedy Foundation endeavors to respond to a verifiable request within thirty (30) days of its receipt. If more time is required, the World Comedy Foundation will inform you of the reason and extension period in writing.

Any disclosures will only cover the 12-month period preceding receipt of the verifiable consumer request. The response we provide will also explain the reasons the World Comedy Foundation cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.
 

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

 

Non-Discrimination

The World Comedy Foundation will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  1. Deny you goods or services.

  2. Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.

  3. Provide you a different level or quality of goods or services.

  4. Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

 

Changes to Our California Privacy Notice

The World Comedy Foundation reserves the right to amend this privacy notice at our discretion and at any time. When changes to this privacy notice are made, the modification date at the beginning of this Notice will change. Your continued use of World Comedy Foundation products and services following the posting of changes constitutes your acceptance of such changes.

Notification of Copyright and Intellectual Property Infringement

The World Comedy Foundation platform relies upon Member-submitted data to perform a function of service. All members participating with the World Comedy Foundation will submit data in the form of body text, photographs, digital media, audio, artwork, designs, or other files that will be displayed publicly on the World Comedy Foundation website, app, print marketing or digital promotion. By submitting content to the World Comedy Foundation, Members agree that the content they submit is original to them and/or that they have obtained the copyright to the content; that they have the authority to submit and display the work; that the work does not infringe the intellectual property rights, moral rights, trademark or copyright of others; and that the content is not defamatory, false, or plagiarized.  

 

The bThThe World Comedy Foundation responds to notices of alleged copyright and intellectual property infringement that comply with the Digital Millennium Copyright Act ("DMCA") and other applicable intellectual property laws. Please be aware that copies of any legal notices may be sent to one or more third parties who may make it available to the public.
 

Before you file any notification with the World Comedy Foundation, we strongly encourage you to contact the Producer, Performer, or Member to see if you can resolve the infringement issue directly. In most cases, the Producer, Member or account holder provides contact information on their World Comedy Foundation event page or their account page. World Comedy Foundation acts as both a "data processor" and a "data controller". World Comedy Foundation is a data processor because our service offers a platform for public representation and personal portrayal for Members, Performers and Producers to share information with others, to use a registration and ticketing system to bring other World Comedy Foundation Members and members of the general public to their live or virtual shows or events and collect and access data about Members and Performers to communicate with and admit them into their events. The World Comedy Foundation is a data controller because the information provided by Members, Performers, Producers, ticket buyers, and attendees is stored with World Comedy Foundation to record attendee information and payment transactions.

 

1. Collection of Personal and Financial Information

We use, store, and process information, including personal information, about you to provide, understand, improve, and develop the World Comedy Foundation website and services, create and maintain a trusted and safer environment, and comply with our legal obligations.

World Comedy Foundation collects your data in two primary ways:

Additional information is added to the system by Members, Performers and Producers with paid subscription accounts, to utilize special web tools and services offered by the World Comedy Foundation.   • Account Information. When you sign up for a World Comedy Foundation account, we require certain information such as your email address, first name, last name, and nearest city. Additional information for unpaid accounts is optional, including telephone number, mailing address, and birthday.
     

  • Additional Account and Payment Information. To use certain features of the World Comedy Foundation system (such as building your own public website, listing a live or virtual show or event, representing a venue or purchasing a ticket), we may need additional information, which may include first name, last name, email address, physical address, business name, banking information, credit card information, PayPal information, in order to facilitate the processing of payments. This information may also include photos, videos, URLs and other pieces of digital media for which you hold the intellectual property right. Where you have provided consent, we share your information with the specific Producer of the event you registered for and/or purchase tickets to. We also share your information with other Members and Performers when you opt in to doing so for various purposes, including getting booked by Producers for live shows. When you list for a show or purchase a ticket, your personal contact information will be provided to the Producer. World Comedy Foundation has no control over what a Producer does with your information, and this Privacy Policy does not apply to the practices or actions the Producer takes outside of the World Comedy Foundation system.
 

3.2 Member Public Profiles, Performer and Venue Data, Producer Event Listings, and Other Public Information

The World Comedy Foundation website lets paid subscribing Members portray and represent themselves professionally via their own website. We also allow Producers to list events to register Performers and sometimes sell tickets. The information you provide about yourself, including text, photos, links, schedule, and contact information, and the mics, shows and events you list are viewable by the public, and include information you provide, such as name and contact information, which is visible to your attendees, potential attendees, and the general public. Publicly visible information on the internet may be "scraped" or indexed through third party tools or search engines. The World Comedy Foundation does not control the practices of third parties accessing your public-facing information.
 

3.3 Compliance with Law, Preventing Harm, Responding to Legal Requests and Protection of Our Rights

The World Comedy Foundation may disclose your information, including personal information, to courts, governmental or law enforcement authorities, or authorized third parties, if and to the extent we are required or permitted to do so by law, or if such disclosure is reasonably necessary: (i) to comply with our legal obligations, (ii) to comply with legal process and to respond to claims asserted against World Comedy Foundation, (iii) to respond to verified requests relating to a criminal investigation or alleged or suspected illegal activity or any other activity that may expose us, you, or any others to danger or legal liability, (iv) to enforce and administer our Terms of Service, or (v) to protect the rights, property or personal safety of World Comedy Foundation, its employees, its Members, Performers, Producers or ticket buyers, or the general public.

3.5 Social Media

Where permissible according to applicable law we may use certain limited personal information about you, such as your email address in an anonymized and hashed format to share with social media platforms, such as Facebook or Google, to generate leads, drive traffic to our website or otherwise promote our products and services or the World Comedy Foundation website.   • If you have purchased a ticket or registered for an event, World Comedy Foundation cannot remove your information before the completion of the event for business and fraud prevention purposes.
     

  • We may retain some of your personal information as necessary for our legitimate business interests, such as fraud detection and prevention and enhancing safety. For example, if we suspend a World Comedy Foundation account for fraud or safety reasons, we may retain certain information from that account to prevent the opening of a new World Comedy Foundation account in the future.
